We highly recommend that each Users read our Terms & Conditions. This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the MyClozet.net Services. This Agreement is a legal contract between you and MyClozet.net governing your access to, and use of the MyClozet. These Terms & Conditions are in effect from 1st August 2008. Any breach of the Terms & Conditions could result in the Suspension or disqualification of a User's activities on The Site. The Site reserves the right to amend the Terms & Conditions from time to time as it sees fit and without prior notification.MyClozet provides a collection of online resources, including classified ads (referred to hereafter as "the Service"). By using the Service in any way, you are agreeing to comply with the Terms and Condition. In addition, when using particular MyClozet services, you agree to abide by any applicable posted guidelines for all MyClozet services, which may change from time to time. Should you object to any term or condition, any guidelines, or any subsequent modifications thereto or become dissatisfied with MyClozet in any way, your only recourse is to immediately discontinue use of MyClozet. MyClozet has the right, but is not obligated, to strictly enforce the Terms of Use through self-help, community moderation, active investigation, litigation and prosecution.

1.SELLER

As a Seller, Users must post their add in MyClozet. Users must describe their items in a fair and accurate manner and avoid using explicit, vulgar or intimidating language. Any images added and videos(these are not compulsory, but will help as a selling tool - see Selling tips) must be clear and avoid being sexually explicit or suggestive. Offensive images or use of language will cause the item to be removed. Please ensure that the items are listed in the correct category. Ensure that the listings and contents are legal and true. The Site is also not responsible to check each and every item and accepts no responsibility or liability for any content of individual listings. The site expects the Users to responsibly take steps to avoid infringement of the Trademarks, Copyrights or Rights of third parties. Any illegal activities can be brought to attention by writing to us at reportabuse@myclozet.net. Site does not check each and every item and therefore accepts no responsibility or liability for any content of individual listings. However, The Site reserves the right to alter listings as it sees fit, within reasonable limits and if it deems it necessary, without prior notification to the User. The seller will at all times behave in a kindly and considerate manner towards potential customers in the spirit of The Community and in the event of a dispute, do all they can to resolve the matter amicably and swiftly. The Site accepts no responsibility or liability for the outcome of any disputes whether directly or through the legal system. The Site expects Users to be responsible in listing their items and to avoid knowingly infringing the Trademarks, Copyrights or Rights of any third parties. Any instances of this should be brought to the attention of The Site by writing to us at reportabuse@myclozet.net . The Site will do all it can to ensure that the Copyrights, Trademarks and rights of third parties are taken into account, However the site accepts no responsibility or liability for any breaches or infringements. The site also expects the seller from fair and prompt response to the potential buyer. The site is not responsible for any problems between the seller and buyer in transaction.

2.BUYER

Any visitor to The Site is welcome and they may browse through the items listed. In order to make a purchase the buyer has to contact the seller. Communication between the buyer and the seller may be initiated as listed in the ad. The Site and refrain from using explicit, vulgar or intimidating language. Any reports of such behaviour may result in immediate Suspension or disqualification from The Site and should be reported to the Site via reportabuse@myclozet.net . It is the sole responsibility of the buyer to query any questions regarding the purchase. The site cannot monitor each transaction. Any returns or cancellations of the sale are the sole responsibility and subject to negotiations between the buyer and seller and The Site cannot accept responsibility or liability for any stage of the purchase. This includes, but is not limited to, handling disputes, returns or damaged goods whether in transit or at any other time. Therefore the communication between the SELLER and BUYER is must. Since MyClozet is not responsible for any damage.

3.DURATION OF LISTING AND CANCELLATION

The item can be listed in the site for the duration of 15 days for free. After which it will be removed from the site. The listing is for free. If the seller wants to list is again then he/she needs to post the add again. Multiple garments within any single listing are prohibited, (except where indicated) and The Site reserves the right to remove any items it feels are in breach, or to edit them, without prior warning.

4.DISPUTES

Whether between User or between Users and The Site, all disputes arising from or connected with The Site should be settled swiftly and in a manner suiting both parties. The Site accepts no liability or responsibility from any action arising from said disputes.

5. PROHIBITED PRACTICES

Any type of contact to the seller or buyer,other then interest in purchasing the item is strictly forbidden. It is also forbidden for any User to solicit or send Spam electronic or surface mail to any other User unless it is in direct connection with a particular item listed on The Site. It is highly recommend that the user do not make and web links made available or displayed anywhere at all on The Site at any time - unless express written permission has been granted by The Site.

6. TERMINATION OF SERVICE

You agree that My Clozet, in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content within the Service, for any reason, including, without limitation, if Further, you agree that My Clozet shall not be liable to you or any third-party for any termination of your access to the Service. Further, you agree not to attempt to use the Service after said termination.

7. DISCLAIMER OF WARRANTIES YOU AGREE THAT USE OF THE My Clozet SITE AND THE SERVICE IS ENTIRELY AT YOUR OWN RISK. THE My Clozet SITE AND THE SERVICE ARE PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, My Clozet DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE My Clozet SITE AND THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, My Clozet DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE My Clozet SITE OR THE SITES OR SERVICE, OR ACCESSED THROUGH ANY LINKS ON THE My Clozet SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, My Clozet DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE My Clozet SITE OR THE SERVICE. Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.
